Terms of Service

These Terms govern your use of crushitsites.com and the services of Crush It Sites, a product of Crush It Media Group LLC ("Crush It Sites," "we," "us"). Please read them, including the arbitration and class-action waiver in the disputes section below. By requesting a preview, purchasing a website, or using this site, you agree to them.

How it works

We build a website for you first and show it to you as a live preview. You decide whether to buy it. A preview is free to review and carries no obligation. Until you purchase it, the preview — its design, code, and copy — remains our property, hosted on our domains, and we may modify, take down, or repurpose it at any time. Information you give us for a preview is used to build it and to contact you about it.

Approval, corrections, and changes

The site we build is the starting point. Before you buy, we'll correct genuine factual mistakes about your business at no charge so the preview is accurate. If you want the site to be different, you accept and pay the quoted price, and we then make a reasonable round of refinements within the site's existing scope. New pages, new sections, new features, or a fundamentally different design are quoted separately.

Pricing and payment

The price to keep a website is a fixed amount quoted to you before any payment, and is due in full when you accept — there is no deposit. Care plan fees, if you choose one, are billed in advance on a recurring basis. Payments are processed by Stripe; we do not store full card numbers. Prices for a specific order are locked once quoted. Refunds and cancellations are governed by our Refund & Cancellation Policy.

Ownership and portability

Once you purchase a site and payment clears, the site's design and content are yours, and you own and control your own domain name. You may take the site elsewhere at any time. We retain ownership of our platform, tools, frameworks, and component library, and the right to reuse general techniques and code that are not specific to your business, and to show your finished site in our portfolio unless you ask us not to.

One honest point: your website is built to run on the Crush It Sites platform. The visual site travels anywhere, but connected features — your lead/contact form, content editor, lead notifications, and instant updates — run on our hosting and technology. If you host the site elsewhere, those features stop working until they are rebuilt, which takes technical setup. If you leave, we will, on request, provide a static export of your site's design and content; we do not warrant that platform-dependent features will operate off our platform.

Hosting and care plans

If we host and maintain your site, the plan and fees are stated in your order. An active care plan keeps your site online and maintained; without one, the site may be taken offline. Small edits are included as described in your plan; new pages, design changes, and new features are quoted separately. You may cancel your care plan at any time — it stays active through the end of the period you've already paid for; we may cancel on 30 days' written notice. If a care-plan payment fails, your site stays online during a 7-day grace period while the charge is retried; after that we may suspend the site until payment is made, overdue amounts may accrue a late fee of 1.5% per month, and accounts more than 30 days overdue may be terminated. Suspension is not deletion — your ownership of your domain and content is unaffected.

Your content

You are responsible for the accuracy and legality of information you give us about your business (names, licensing claims, prices, photos, reviews) and for any required privacy or regulatory disclosures on your site. You confirm you have the right to use any material you supply, you license us to use it to build and operate your site, and you agree to indemnify us against claims arising from content you provide.

Acceptable use

Our services may not be used for unlawful content or deceptive practices. We may decline or discontinue work that, in our judgment, would require us to publish content that is illegal or misleading, and we may suspend or terminate access for violations.

Disclaimers

Websites and services are provided "as is" and "as available," without warranties of any kind to the extent permitted by law. We do not guarantee any specific search rankings, traffic, call volume, lead volume, or revenue. We are not responsible for third-party services (such as Stripe or your domain registrar) or for issues outside our control.

Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, consequential, or lost-profits damages (such as lost revenue or lost data). Except for your payment obligations, each party's total liability arising out of or relating to the services will not exceed the total fees you paid or owe us in the three months before the event giving rise to the liability.

Dispute resolution; binding arbitration; class-action waiver

If a dispute arises, contact us first at support@crushitsites.com and give us 30 days to resolve it informally. Except for claims that qualify for small-claims court, any dispute, claim, or controversy arising out of or relating to these Terms or the services will be resolved by final and binding arbitration, not in court. You and we each agree that claims may be brought only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. You may opt out of this arbitration agreement by emailing support@crushitsites.com within 30 days after you first accept these Terms, stating your name and that you opt out of arbitration.

Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. For any matter not subject to arbitration, the exclusive venue is the state or federal courts located in Hillsborough County, Florida (Tampa).

Changes and contact

If these Terms change, the new version is posted here with a new effective date; material changes to an active order are agreed with you directly. Questions can go through the contact page or to support@crushitsites.com.
